§ 20-212. Membership.

  • The board of adjustment shall be composed of five (5) members, freeholders, citizens of the City of Clinton, each appointed by the mayor with the approval of the city council for a term of five (5) years; provided, however, that the terms of the existing board of adjustment, appointed to staggered terms in accordance with the provisions of Chapter 89 RSMo, shall continue. Three (3) alternative members may also be appointed to serve in the absence of or the disqualification of the regular members.

    The city clerk shall be considered a non-voting ex officio member of the board of adjustment and shall serve as secretary of the board.

    Members of the city council, city planning commission, the director of public works, city attorney, city engineer or other municipal officials shall not be appointed to the board of adjustment.

    Board of adjustment members, once appointed, can thereafter be removed only for cause, upon written charges, and after a public hearing. Vacancies shall be filled by the appointing authority for the unexpired term of any member whose office becomes vacant.

    The board shall elect a chairman and an acting chairman from its membership, who shall serve for a term of office of one (1) year.
